Record of the Last Will & Testament of Elizabeth Allbaugh, Deceased
In the name of the benevolent Father of all,
I Elizabeth Allbaugh of Harrison County, Ohio do make and publish this my
last Will & Testament. First, it is my will that my just debts
and all charges be paid out of my estate.
Item 1st I give and
devise all the residue of my estate consisting of goods, chattles, and my
patrimony in my fathers estate to James Allbaugh, my husband, to be to
his, his heirs and assigns forever.
2nd I do hereby nominate William
Beadle executor of this my last Will and Testament
In testimony whereof I have hereunto set my hand and
seal this first day of January in the year A.D. 1858.

Signed and acknowledged by said Elizabeth Allbaugh as her last Will and
Testament in our presence and signed by us in her presence.

The last Will & Testament of Elizabeth Allbaugh late of
Harrison County in the State of Ohio was this day produced in Court by J.H.
McMath, Esq.: and William W. Custer and Samuel Allbaugh the subscribing
witnesses to said Will appeared and in open Court on Oath testified to the
due execution of said Will which testimony was reduced to writing and by
them respectively subscribed and filed with said Will and it appearing to
the Court by said Testimony that said Will was duly attested and executed
and that said Executrix at the time of executing the same was of full age
and of sound mind and memory and not under any restraint. It is
ordered by the Court that said Will be admitted to Probate and that said
Will and Testimony be recorded.
Whereupon William Beadle, the Executor in said Will named appeared in
Court and declined accepting of the trust of Executing said Will which
declination is accepted by the Court.

It appearing here to the Court that the last Will and Testament
of Elizabeth Allbaugh was admitted to Probate in this Court on the 27th
day of January A.D. 1858 and that the Executor therein named declined
accepting trust. It is also here appearing to the Court that the
next of kin has been duly notified to take administration on said estate
and have failed to appear and take administration. Therefore
the Court appoint James Allbaugh Administration with the Will
annexed on the estate of the said Elizabeth Allbaugh dec'd. The
Court also appoint Robert McCoy, Charles Madison and Charles Dolly
appraisers of the personal estate of said Testatrix. It is ordered
by the Court that said James Allbaugh give bond in the sum of Four hundred
dollars with William Allbaugh and Eli Canage as surities conditioned
according to law. And thereupon the said James Allbaugh appeared in
Court and accepted said appointment, and gave bond accordingly.
Ordered by the Court that Letters issued to him accordingly.
