Will & Codicil

Last Will and Testament of Elizabeth Albaugh, wife of Daniel Albaugh, do make and
publish this my last will and testament, hereby revoking and making void all former
wills by me at any time heretofore made, and -

First I commit my Soul in the hands of Almighty God and my body to be decently buried and my funeral to be conducted in a manner corresponding with my Estate and situation in Life and as to
such worldly Estate as it has pleased God to entrust me with I dispose of the same in
the following manner

First I give and bequeath into my husband Daniel Albaugh 1 bedstead, 1 bedding and 1
red chest for his own use during his life then I give and bequeath unto my daughter
Sena Catharine wife of Saml Coleman all the balance of my personal property consisting of household and Kitchen furniture, not only that which I had of my own, but also that portion which I
inherited from my sister Catharine Diehl, and also my curio if I have one at the time
of my decease, all of which my daughter is to have during her life, for which she is to
pay my debts and funeral expenses. Next, I give and bequeath unto my daughter Sena
Catharine all my money in the house and the bank or at interest to be invested in
Real Estate if not already so invested, on which my husband Daniel Albaugh is to have
@ home with her, living his life or as long as he may remain unmarried, all
of which my daughter is to have and to hold in her possession during her natural life
and at her death then to fall to her children, share and share alike.

And lastly I do hereby make and ordain my esteemed brother Moses Diehl Executor of
this my last will and testament in witness whereof I Elizabeth Albaugh the testator
have to this my will, written on this sheet of paper. Set my hand and seal this
thirteenth day of March in the year of our Lord one thousand Eight hundred and
Seventy Seven.

Codicil to Her Will

Codicil to the last will & testament of Elizabeth Albaugh bearing the date March 13th Eighteen hundred and Seventy Seven (1877).

Whereas I Elizabeth Albaugh of Frederick County, Maryland having made & duly executed my last will and testament on the date above described, but having since purchased real estate, do therefore make this codicil as an additional to the foregoing will, and direct the same to be annexed thereto, and taken as a part thereof.

1st I give and bequeath all my real estate lying in Johnsville District Fredk Co Md on the road leading from Middlesburg to Johnsville, adjoining the lands of David Gropnickle* & others containing about seven acres more or less with all the improvements thereon: to my daughter Sena Catharine, which she is to have and to hold during her natural life, then at her death to fall to her son Wm Edward Coleman , if she has no more children. If she has any more to be dised* share & share alike to have and to hold forever.

Next I further direct that the above named property shall not be sold by Daniel Albaugh, nor Samuel Coleman nor any debts to be paid out of it contracted by the aforesaid Albaugh & Coleman, but soley to belong to my daughter & after her death to the offspring.

And Lastly I do hereby appoint my brother Moses Diehl Executor, in Witness whereof I Elizabeth Albaugh the testator hereunto Set my hand and seal this Twenty ninth day of July Eighteen hundred and eighty seven.

Maryland, Frederick County To-Wit
         On this 15th day of March 1893 came Jacob H. Diehl and made affirmation that the aforegoing instrument of writing is the true whole will and testament of Elizabeth Albaugh, late of Frederick county, deceased, that has come to his hands and possession: that he received the same from Mrs Wm Bowman who received the same from the testatrix for safe keeping and that he does not know of any other of a later date.

State of Maryland, Frederick County To-Wit:
         On the 13th day of March 1893 came Jesse R. Fox one of the Subscribing witnesses to the aforegoing last will and testament of Elizabeth Albaugh, late of Frederick county, deceased, and affirmation that he did see Elizabeth Albaugh the testatrix thereon named sign and seal this will, that he heard her publish, pronounce and declare the same to be her last will and testament, that at the time of her so doing she was to the best of his apprehension of sound and disposing mind, memory and understanding and capable of executing a valid deed or contract and that he respectively subscribed his name as witness to said will in the presence of and at the request of the testatrix, and that he did also see each the other subscribing witness sign his name as witness to said will at the request of the testatrix in her presence and all in the presence of each other and that the names of Wm. H. Bowman and Bradly C. Bowman are in their own hand writing.

         On the 13th day of March 1893 came Jacob H. Diehl and Samuel W. Myers two
of the subscribing witnesses to the aforegoing last will and testament of Elizabeth Albaugh late of Frederick county deceased, and made affirmation that they did see Elizabeth Albaugh the testatrix therein named sign and seal this Codicil: that they heard her publish pronounce and declare the same to be a Codicil to her last will and testament, that at the time of her so doing she was to the best of their apprehension of sound and disposing mind, memory and understanding and capable of executing a valid deed or contract and that they respectively subscribed their names as witnesses to said Codicil in the presence of and at the request of the testatrix and that they did also see each the other subscribing witnesses sign his name as witness to said Codicil at the request of the testatrix in her presence and all in the presence of each other and that the names of Wm H. Bowman is in his own handwriting.

In the Orphans Court of Frederick County
         The court after having carefully examined the above last will and testament of Elizabeth Albaugh, late of Frederick county, deceased together with the Codicil thereunto attached, and also the evidence added as to its validity, orders and decrees this 14th day of March A.D. 1893, that the same be admitted to probate in this court as the true and genuine last will and testament and codicil of the said Elizabeth Albaugh, deceased.
