James Dubois to Harrison W. Albaugh
Land Records, Jefferson OH Know all men by these presents that we James
Dubois and his wife Mary E. Dubois of Dubuque County and State of Iowa in
consideration of the sum of Three hundred and forty five dollars in hand paid by
Harrison W. Albaugh of Jefferson County and State of Ohio, have bargained and
sold and do hereby sell and convey unto the said Harrison W. Albaugh his heirs
and assigns forever, the following premises Situate in Wayne Township, Jefferson
County and State of Ohio and in the Steubenville Land district. The same being
a part of the North East quarter of Section twenty two, Township nine and Range
three and bounded as follows: to wit: Beginning at a stone standing in the West
side of an alley, and corner to Samuel Copelands land, and running thence with
said Samuel Copelands land North Eighty and one fourth degrees west twenty on
and two tenths perches to an Ash Stump, thence South thirty five and one half
degrees West, twenty five and eight tenths perches to a stone at a Chestnut
Stump, thence by land of J.M. Jamieson South seventy five and a half degrees
East twenty three and five tenths perches to a stone at said alley west of the
Town of Bloomfield, thence by said alley North twenty eight degrees East twenty
six and eight tenths perches to the place of beginning, containing three acres
and eighty hundredths of an acre. (3 80/100) A. be the same more or less. To
have and to hold said premises with the appurtenances unto the said Harrison W.
Albaugh his heirs and assigns forever. And the said James Duboise and his wife
Mary E. Duboise for themselves and heirs doth hereby covenant with said Harrison
W. Albaugh his heirs and assigns that they are lawfully seized of the premises
aforesaid that the premises are free and clear from all incumbrances whatsoever,
and that they will forever warrant and defend the same with the appurtenances
unto the said Harrison W. Albaugh his heirs and assigns against the lawful
claims of all persons whomsoever. In Testimony whereof the said James Dubois
and Mary E. Dubois hereunto set their hands and seals this first day of April in
the year of our Lord Eighteen hundred and Sixty four. On this first day of April 1864 before me a
Justice of the Peace in & for said County personally appeared James Dubois &
Mary E. Dubois his wife to me personally known to be the identical person whose
name are affixed to the above deed as grantors and acknowledged the same to be
their voluntary act and deed and the said Mary E. Dubois wife of James Dubois
being by me made acquainted with the contents of said instrument acknowledged on
an examination apart from her husband that she did execute the same and
relinquished her right of Dower to the Real Estate therein conveyed, voluntarily
and without compulsion or undue influence of her husband. Witness hand and seal
the day & year above written. In witness whereof I have hereunto set my
hand and affixed my seal of said Court, at office in the City of Dubuque, this 4th
