Dilloplane & Pittenger to Peter Albaugh
Land Records, Frederick, MD At the
request of Peter Albaugh the following Release of Mortgage was This Indenture made this first day of June
in the year of our Lord one thousand seven hundred and eighty nine Between
Joshua Dilloplane and William Pittneger both of Frederick County in the State of
Maryland Yeoman of the one part and Peter Albaugh of the same County and State,
Yeoman of the other part. Witnesseth that the said Joshua Dilloplane and
William Pittenger for ***** good causes and Consideration them there unto
moving Hath revised released and forever quit claimed, and by these presents
for themselves and their Heirs do fully clearly and absolutely revise release
and forever quit-claim until the said Peter Albaugh and his Heirs all that Tract
or parcel of Land called the Two Brothers’ being part of a Tract of Land called
the Resurvey on Welsh Cabbin situate lying and being in Frederick County
aforesaid and containing two hundred and forty acres of Land more or less which
said Tract or parcel of Land was heretofore mortgaged to the said Joshua
Dilloplane and William Pittenger by the said Peter Albaugh by virtue whereof and
the Statue for transferring uses into possession the said Peter Albaugh is in
actual possession of the said Tract or parcel of Land, and all and singular the
House Fences Benefits and Improvements to the same belonging, and also the
Revision and Revisions, Remainder and Remainders Right Estate Interest Benefit
Claim and demand of them the said Joshua Dilloplane and William Pittenger of in
or to the said Tract or parcel of Land and premises herein before mentioned or
intended to be hereby released. To Have and to hold the said Tract or parcel of
Land and premises with the Appurtenances to the said Peter Albaugh and his Heirs
to the only Use and Behoof of him the said Peter Albaugh his Heirs and Assigns
forever so that neither they the said John Dilloplane and William Pittenger nor
heir or Heirs shall or will hereafter have claims challenge or demand any Estate
Right Title or Interest of in or to the premises or any part or parcel thereof.
In witness whereof the parties to these presents have interchangeably set their
hands and affixed their seals the day and year first within
written Joshua Delaplane (seal) Sealed and delivered } John Ross
Key Which was thus endorsed to wit ~~ On the 1st day of June 1789, came the within named Joshua Dilloplane and William Pittenger before us two Justices of Frederick County and acknowledged the within and above Instrument of Writing to be their Act and the Land and premises therein mentioned to be revised released and quit claimed to be the indefianble Right and Estate of the within named Peter Albaugh and his Heirs according to the true Intent and Meaning of the same.
