11 May 1792,  Daniel Albaugh to Francis Harter

              At the request of Francis Harter the following deed of Confirmation                   
was recorded 11th May 1792. to wit ~

This Indenture made this eighth day of May in the year of our Lord one thousand seven hundred and ninety two Between Daniel Albaugh Weaver of Frederick County and State of Maryland of the one part and Francis Harter of Washington County and State aforesaid of the other part.  Witnesseth that the said Daniel Albaugh for and in consideration of the sum of twelve pounds current Money of this State aforesaid to him in hand paid by the said Francis Harter this receipt whereof the said Daniel Albaugh doth hereby acknowledged  and for and in consideration of the yearly rent of seven shillings and six pence current money as aforesaid to be paid to Richard Coale his Heirs Executors or Administrators or Assigns yearly and every year forever which Annuity commences on the twenty second day of June seventeen hundred and eighty seven the aforesaid Daniel Albaugh Hath bargained sold aliened released and confirmed and by these presents doth grant bargain sell alien release and confirm unto him the said Francis Harter his Heirs and Assigns forever.  All his the said Daniel Albaugh right Title Interest and property of in and to all the following Lott of Ground in the Town of Liberty in Frederick County aforesaid on a draught of Linganore called Piney Run being part of a Tract of Land called Dukes Woods the said Lott being Number Thirty five

In the said Town Beginning at a Stone marked DÆ  (D & AB together) and running thence South four degrees past three hundred feet then South eighty six degrees West fifty feet North four degrees West  three hundred feet then by a straight line to the beginning containing one of the Town Lotts Together with all and singular the Buildings and Improvements and all the premises and appurtenances to the said Lott belonging or in any wise appertaining.  To have and hold the said Lott of Ground together with the premises and appurtenances  on the Condition above mentioned unto him the said Francis Harter his Heirs and Assigns forever to the only purpose use and Behoof of him the said Francis Harter his Heirs and Assigns and to no other use Intent or purpose whatsoever ~~  And the said Daniel Albaugh for himself and his Heirs doth hereby promise consonant and agree to and with the said Francis Harter his Heirs and Assigns that he the said Daniel Albaugh and his Heirs shall and will from time to time and at all times forever warrant and defend the said Lott of Ground and premises with the appurtenances against all manner of persons claiming or to claim any Right Title or demand unto the said Lott of Ground and premises with the Appurtenances from by or under him the said Daniel Albaugh and his Heirs.~~    And the said Daniel Albaugh doth further covenant for himself and his Heirs to and with the said Francis Harter his Heirs and Assigns that he the said Daniel Albaugh and his Heirs shall and will from time to time hereafter at the proper Cost and Charge of him the said Francis Harter his Heirs or Assigns make acknowledge or suffer all and every such further Act or Acts Conveyance or Conveyances in the Law as by the said Francis Harter his Heirs or Assigns or his or their Council shall advise for the further and Sell or Assurance of all and singular the premises hereby bargained and said or intended to be bargained and sold according to the true Intent and Meaning of these presents.  In Witness whereof the said Daniel Albaugh hath hereunto set his Hand and Seal the day and year above written                  Daniel Albaugh  (seal)

Which was thus endorsed to wit ~~

Received May the eighth 1792 of Francis Harter the sum of twelve pounds current Money the Consideration within mentioned except the yearly Rent

On the 8th day of May 1792 came the within named Daniel Albaugh before us the Subscribers two of the Justice of the Peace for Washington County and acknowledged the within Instrument of Writing to be his Act and Deed, and the Lott of Ground and premises  therein mentioned to be the right and Estate of the within named Francis Harter his Heirs and Assigns forever                    Alex’r Clagett     Ad’m Ott

Maryland Washington County  sch.    I do hereby certify that Alexander Clagett and Adam Ott  Gentlemen before whom the above Acknowledgment  was taken and where names appear thereto subscribed are two of the Justice of the Peace in and for the said County aforesaid duly commissioned & Sworn
