David Albaugh to Robert Cumming

Executed Granted   }          At the request of Robert Cumming the following deed was recorded
20th March 1803     }           11th April 1795, to wit ~~

This Indenture made this twenty second day of January in the year of our Lord one thousand seven hundred and ninety five    Between David Albaugh of Frederick County and State of Maryland, Farmer of the one part, and Robert Cumming of the same county and State, Merchant of the other part.  Witnesseth that the said David Albaugh for and in consideration of the sum of sixty pounds current money to him in hand paid the receipt whereof he doth hereby acknowledge and also for and in consideration of the sum of fifteen shillings current money to be paid yearly and every year on the twenty second day of June to Richard Coale his heirs or assigns as by his deed to said Albaugh bearing date the twenty seventh day of March in the year one thousand seven hundred and eighty eight doth appear  Hath granted bargained sold aliened enfeoffed and confirmed , and by these presents doth bargain sell alien enfeoff and confirm  unto the said Robert Cumming his heirs and assigns  All the following described parcels of ground to wit ~~ one back lot of ground in the town of Liberty lying and being in Frederick County aforesaid on a draught of Linganore called Piney Run being part of a Tract of Land called Dukes Woods the said back lot being numbered on the plan of the said Town one hundred and ninety four  Beginning at a stone marked (AB together) and running thence North four degrees West three hundred feet then south eighty six degrees West fifty feet then South four degrees East three hundred feet then by a straight line to the beginning containing one of the Town back lots of this Town of Liberty aforesaid ~~  Also one parcel of ground adjoining the Town of Liberty aforesaid and the aforesaid back lot Number one hundred and ninety four on the East side thereof being part of the Tract of Land called Dukes Woods aforesaid Beginning at a Stone setup and marked with the Letters and running thence North four degrees West three hundred feet then South eighty six degrees West fifty feet then South four degrees East three hundred feet then by a straight line to the Beginning containing and laid out to be one of the Town Lots of Liberty, that is equal in quantity to one of the Town Lots aforesaid, and all and singular the Houses Gardens Fences and Improvements to the said two Lots or parcels of Ground and premises belonging  with their and every of their Appurtenances, and also the revision and revisions and remainder and remainders Right Estate Interest Benefit Claim and Demand whatsoever except the rent reserved for the use of Richard Coale aforesaid, of him the said David Albaugh and his heirs of in and to all and singular the premises and Improvements with their and every of their Appurtenances and of in and to every part and parcel of them  To have and to hold the said bargained Lots or parcels of Ground and all and singular other the premises, unto him the said Robert Cumming his heirs and assigns forever to the only Use and Behoof of him the said Robert Cumming his heirs and Assigns ~~ And the said David Albaugh for himself and his heirs the said bargained Lots or parcels of Ground and premises, and all and singular  other the Improvements to the same belonging or in anywise appertaining unto him the said Robert Cumming his Heirs and Assigns against him the said David Albaugh his heirs and Assigns and all persons whatsoever claiming by from or under him or them except as before excepted, shall and will warrant and forever defend  In Witness whereof the said David Albaugh has set his hand and seal the day and year aforesaid.

Which said Deed was thus endorsed:

Received this 22nd day of Jan. 1795 of the within named Robert Cumming the sum of sixty pounds current money it being the Consideration Money within mentioned   As Witness my Hand              David Albaugh

On the 22nd day of Jan. 1795 came the within named David Albaugh before us  two Justices of the Peace for Frederick County and acknowledged the within Instrument of Writing to be his Act and Deed and the Lots or parcels of Ground therein mentioned to be the Right and Estate of the within named Robert Cumming his heirs and Assigns forever according to the true Intent and Meaning of the same.  And at the same time appeared before us Magdalena wife of the David Albaugh who being examined by us apart from and out of the hearing of her said husband acknowledged her right of Dower in the Lotts or parcels of Ground within mentioned and that she did the same freely and voluntarily without being induced thereto by Fear or Threats of ill usage by her said husband or fear of his displeasure                                                                          Wm Beatty                F.B.
