Daniel Albaugh to Peter Goshower
Land Record, Frederick MD Examd del Granted Order } At the request
of Peter Goshower the following deed was recorded This Indenture made this seventh day of
February one thousand seven hundred and ninety three Between Daniel Albaugh of
Frederick County and State of Maryland, Farmer of the one part and Peter
Goshower of the same county and State aforesaid of the other part. Witnesseth
that the said Daniel Albaugh for and in consideration of the sum of twenty five
pounds current money to him in hand paid by the said Jacob Goshower the receipt
whereof the said Daniel Albaugh doth hereby acknowledge and himself therewith to
be fully satisfied contented and paid and for and in consideration of the yearly
ground rent of seven shillings and six pence current money to be paid to John
Young or to his heirs or assigns on the twenty second day of June yearly and
every year hereafter forever. Hath given granted bargained sold aliened
released and confirmed and by these presents doth give grant bargain sell alien
release and confirm unto him the said Peter Goshower his heirs and assigns
forever all his the said Daniel Albaugh Right Title Interest Claim and Property
of in and to all the following Lot of Ground in the Town of Liberty laying and
being in Frederick County and State aforesaid on a draught of Linganore called
Piney Run being part of a Tract of Land called Dukes Woods and being Numbered in
this place of said Town Ninety six and Beginning at a stone set up and marked
PG.
And running thence South four degrees East three hundred feet then
South eighty six degrees West fifty feet then North four degrees West three
hundred feet then by a straight line to the Beginning containing one of the
aforesaid Town Lotts Together with all and singular the Buildings Premises and
Appurtenances to the said Lott of Ground belonging or in any wise appertaining.
To have and to Hold the said Lott of Ground with the premises thereunto
belonging unto the said Peter Goshower his heirs and assigns forever on the
condition above mentioned to no other Use Intent and Behoof of him the said
Peter Goshower his heirs and assigns and to no other Use & Intent whatsoever.
And the said Daniel Albaugh doth covenant for himself his heirs and Assigns to
and with the said Peter Goshower his heirs and Assigns that he the said Daniel
Albaugh his Heirs and Assigns shall and will from time to time and at all times
forever here after warrant and defend the said Lot of Ground and premises with
its Appurtenances against all manner of persons claiming any Right Title
Interest or Property unto the aforesaid Lot of Ground by or under him the said
Daniel Albaugh his Heirs and Assigns. And the said Daniel Albaugh his Heirs and
Assigns doth further covenant for themselves to and with the said Peter
Goshower his heirs and assigns that he the said Daniel Albaugh his heirs and
assigns shall and will from time to time and at all times forever hereafter at
the proper cost and charges of him the said Peter Goshower his heirs and
assigns. And the said Daniel Albaugh his heirs do make acknowledge suffer
execute or cause to be made and done acknowledged suffered and executed all and
every such further act of acts, Thing or Things, Assurances or Conveyances in
the Law as by the said Peter Goshower, his heirs and assigns or his or their
council learned in the Law shall be reasonably devised advised or required for
the further and better assurances Surety and Suremaking of all and singular the
premises hereby bargained sold or to be hereby intended to be bargained and sold
according to the true Intent and Meaning of these presents. In Witness whereof
the said Daniel Albaugh hath hereunto set his hand and affixed his Seal the day
and year within written. Daniel
Albaugh (seal) Which was thus endorsed Received February 11th 1793 of
Goshower the sum of twenty five pounds current money the Consideration expressed
in the within Deed. Daniel Albaugh On the 11th day of February 1793
came the within named Daniel Albaugh and acknowledged the within Instrument of
Writing to be his Act and Deed and the Land and premises therein mentioned to be
the Right and Estate of the within named Peter Goshower his heirs and assigns
forever. At the same time came Elizabeth Albaugh wife to the said Daniel
Albaugh and being by us privately examined from and out of hearing of her said
husband and acknowledged her Right and Dower in the within Lott of Ground and
premises to be the Right and Estate of the within mentioned Peter Goshower his
heirs and assigns forever, and that she did it freely and voluntarily without
being induced thereto by fear or threats or ill usage from her said husband or
for fear of his displeasure.
