Robert Cumming to William Albaugh
Land Records, Frederick, MD This Indenture made this fourth day of April
in the year eighteen hundred & three Between Robert Cumming of Frederick County
and State of Maryland of the one part and William Albaugh of the same County and
State of the other part. Witnesseth that the said Robert Cumming for and in
consideration of the sum of four hundred dollars cash to him in hand paid the
receipt whereof he doth hereby acknowledge and also for and in consideration of
the sum of fifteen shillings current money to be paid yearly and every year on
the twenty second day of June to Richard Coale his heirs and assigns as by his
decd to David Albaugh bearing date the twenty seventh day of March in the year
one thousand seven hundred and eighty eight doth appear, hath granted bargained
Sold aliened enfeoffed & confirmed and by these presents doth bargain sell alien
enfeoff and confirm unto the said William Albaugh his heirs and assigns all the
following described parcels of ground to wit. One back lott of ground in the
town of Liberty lying and being part of a tract of land called Dukes Woods the
said back lot being numbered on the plan of said town one hundred and ninety
four Beginning at a stone marked DAB and running thence north four
degrees west three hundred foot then south eighty six degrees West fifty foot
then south four degrees East three hundred feet then by a straight line to the
beginning containing one of the Town back lotts of the Town of Liberty aforesaid
also one other parcel of ground adjoining the town of Liberty aforesaid and the
aforesaid back lott number one hundred and ninety four on the cast side thereof
being part of a tract of land called Dukes Woods aforesaid beginning at a stone
set-up and numbered DAB and running thence North four degrees West three
hundred foot then south eighty six degrees west fifty foot then south four
degrees East three hundred foot then by a straight line to the beginning
containing and laid out to be one of the Town lotts of Liberty that is equal in
quantity to one of the four lots aforesaid and all and singular the houses
gardens fences and improvements to the said two lotts or parcels of ground and
premises belonging with their and every of their appurtenances and also the
revisions and revisions, remainder and remainders Right Estate Interest Benefit
Claim and demand whatsoever (except the rent reserved for the use of Richard
Coale aforesaid, of him the said Robert Cumming and his heirs of in and to all
and singular the premises and improvements with their and every of their
appurtenances and of and in and to every part and parcel of them. To have and
to hold the said bargained lots and parcels of ground and all and singular other
the premises unto him the said William Albaugh his heirs and assigns forever to
the only use and behoof of him the said William Albaugh his heirs and assigns
and the said Robert Cumming for himself and his heirs the said bargained lots or
parcels of ground and premises and all and singular other the improvements to
the same belonging or in anytime appertaining unto him the said William Albaugh
his heirs and assigns against him the said Robert Cumming his heirs and assigns
and all persons whatsoever claiming by from or under him or them (except as
before excepted) shall and will warrant and forever defend. In Witness whereof
the said Robert Cumming hath set his hand and seal the day and year first above
written. On the fourth day of April 1803 come the
within named Robert Cumming before us two Justices of the Peace for Frederick
County and acknowledged the within Instrument of Writing to be his Act and deed
and the lots or parcels of Ground therein mentioned to be the Right and Estate
of the within named William Albaugh his heirs and assigns forever according to
the true intent and meaning of the same. And at the same time appeared before
us Mary wife of the said Robert Cumming who being examined by us apart from and
out of the hearing of her said husband relinquished her Right to Dower in the
lots or parcels of ground within mentioned and that she did the same freely and
voluntarily without being induced thereto by fear or threats of ill usage from
her said husband or for fear of his displeasure.
