Richard Coale to David Albaugh

Examined. Granted  }        At the request of David Albaugh the following deed was record  
11 Oct 1790             }        14th April 1788 to wit ~~

This Indenture made this twenty seventh day of March in the year of our Lord one thousand seven hundred and eighty eight Between Richard Coale of Frederick County in the State of Maryland, Merchant of the one part and David Albaugh of the same county and state, Cooper of the other part  Witnesseth that the said Richard Coale for and in consideration of the sum of seven pounds ten shillings current Gold and Silver to him in hand paid the receipt whereof he doth hereby acknowledge, and for and in consideration of the yearly rent of fifteen shillings current Gold or Silver specie to be paid to the said Richard Coale  his Heirs Executors Administrators and Assigns yearly and every year on the twenty second of June in every year ensuing.  Hath granted bargained sold aliened enfoeffed and confirmed and by these presents doth grant bargain sell alien enfoeff and confirm unto him the said David Albaugh and his Heirs all the following described parcels of Ground to wit, one back Lott of Ground in the Town of Liberty lying and being in Fredrick County aforesaid on a draught of Linganore called Piney Run, being part of a Tract of Land  called Dukes Woods the said back Lott being numbered on the plan of the said Town one hundred and ninety four  Beginning at a Stone marked (AB together), and running thence North four degrees West three hundred feet then South eighty six degrees West fifty feet then South four degrees East three hundred feet then by a straight line to the beginning containing one of the Town back Lotts of the Town of Liberty aforesaid~~  Also one other parcel of Ground adjoining the Town of Liberty aforesaid and the aforesaid back Lott Number one hundred and ninety four, on the East side of the said Lott being part of the Tract of Land called Dukes Woods aforesaid Beginning at a Stone set up and marked with the Letters . And running thence North four degrees West three hundred feet then South eighty six degrees West fifty feet then South four degrees East three hundred feet then by a straight line to the Beginning containing and laid out to be one of the Town Lotts of Liberty, that is equal in quantity to one of the Town Lotts aforesaid~~ 

And all and singular the Houses, Gardens, Fences and Improvements to the said two Lotts or parcels of Ground and premises, belonging with their and every appurtenances, and also the provision and concessions remainder and remainders right Estate Interest Benefit Claim and Demand whatsoever  except the rest recorded as aforesaid of him the said Richard Coale and his Heirs of us and to all and singular the premises and improvements with those and every of their appurtenances and of in and to every part and parcel of them To have and to hold  the said bargained Lotts or parcels of Ground, and all and singular other? The premises unto him the said David Albaugh his Heirs and Assigns forever to the only use and behoof of him the said David Albaugh his Heirs and Assigns ~~~  And the said Richard Coale for himself and his Heirs the said bargained Lotts or parcels of Ground and Premises and all and singular of  the improvements to the same belonging or in any wise appertaining unto him the said David Albaugh his Heirs and Assigns against him the said Richard Coale his Heirs and Assigns, and all persons claiming by from or under him or them except as before excepted shall and will warrant and forever defend. ~~~   Provided neceittissess  and it is agreed by and between the parties for themselves and their Heirs respectively that a deed from John Young of Frederick County aforesaid to the said David Albaugh and his Heirs being date on or about the twenty fifth day of April seventeen hundred and eighty six  ~~And one other deed from the said Richard Coale to the said David Albaugh and his heirs bearing the date on or about the twenty fifth day of April seventeen hundred eighty six, which said two deeds appear to be duly  executed and acknowledged and recorded among the Land records of Frederick County the former in Liber WR No. 6 folio 482, 483, 484 and the latter in folio 484 and 485 of the same Book which said two deeds were marsh and intended for the conveyance of the two Lotts or parcels of Ground aforesaid shall be deemed? Construed and taken to be null and void, and of no effect force or obligation whatsoever on the parties or either of them to the said Deeds their Heirs Executors, Administrators and Assigns ~~  And the said two deeds are accordingly by these presents abrogated, and made null and void and of no effect force or consequence whatsoever on or to the parties aforesaid or either of their Heirs and Assigns respectively.  In Witness whereof the parties to these presents have here unto inter changeably set their Hands and seals the day and year first written

Which deed was thus endorsed, viz.

Rec. this 27th day of March 1788 of the within named David Albaugh the sum of seven pounds ten shillings current Gold and Silver Specie it being the Consideration money within mentioned   As Witness my hand                                            Richard Coale

On the 27th day of March 1788 came the within named Richard Coale and David Albaugh, before us two Justices of the Peace for Frederick County and acknowledged the written Instrument of Writing to be their Act and Deed~~  And by the said Richard Coale the Lotts or parcels of Ground within mentioned to be the Right and Estate of the within named David Albaugh his heirs and Assigns forever according to the true Intent and Meaning  of the same~~  And at the same time appeared before us Catharine, the wife of the said Richard Coale who being examined by us apart from and out of the hearing of her said husband acknowledged her Right of Dower in the Lotts or parcels of Ground within mentioned and that she did the same freely and voluntarily without being induced thereto by Fear or Threats of ill usage by her said husband, or for fear of his displeasure
