Christian Albaugh to Amos Albaugh

 

Know all men by these presents that we Christian Albaugh and Catharine Albaugh, wife of said Christian Albaugh of the County of Jefferson, Ohio, in consideration of the sum of Sixteen hundred and fifty dollars in hand paid, and the further agreement of Amos Albaugh the grantee, of the same place, to wit; that the said Amos Albaugh his heirs or assigns is to keep us the said Christian Albaugh and Catharine Albaugh upon the following described farm free of charge, in sickness and in health as long as they may live in good and sufficient boarding, lodging, clothing, washing and attendance, together with all medical aid and expenses thereof, their situation may need, comfortable house room and such necessaries their age and condition may require.  And further, the said Amos Albaugh agrees to keep one horse beast for said Christian Albaugh in winter and summer free of charge upon said farm, They the said Christian Albaugh & Catharine Albaugh have bargained and sold, and assigns forever (provided as aforesaid) the following premises, situate in the County of Jefferson, in the state of Ohio and in the Steubenville land district, and bounded and described as follows,  Being the whole of the North west quarter of Section Twenty five (25) of Township ten (10) in Range three (3) in said land district containing one hundred and sixty acres, be the same more or less, To have and to hold said premises with the appurtenances unto the said Amos Albaugh his heirs and assigns forever.  Provided  always, that if the said Amos Albaugh his heirs or assigns should fail to keep and support them, the said Christian Albaugh & Catharine Albaugh if either of them as specified above then the said Christian or Catharine Albaugh may take possession of said premises until said support is fully satisfied.  And the said Christian Albaugh and Catharine Albaugh for themselves and heirs doth hereby covenant with said Amos Albaugh his heirs and assigns that they are lawfully seized of the premises, aforesaid; that the premises are free and clear from all incumbrances whatsoever; and that they will forever warrant and defend the same with the appurtenances unto the said Amos Albaugh his heirs and assigns, against the lawful claims of all persons whomsoever, their support as aforesaid only excepted.  In Testimony whereof the said Christian Albaugh and Catharine Albaugh have hereunto set their hands and seals this seventeenth day of February A.D. one thousand eight hundred and sixty ~~

The State of Ohio, Jefferson County, SS.
Before me John Gruber a Notary Public in and for said County personally appears the above named Christian Albaugh and Catharine his wife, and acknowledged the signing and sealing of the above conveyance to be their voluntary act and deed, and the said Catharine being at the same time examined by me separate and apart from her husband and the contents of said instrument made known to her by me, she then declares that she did voluntarily sign, seal and acknowledge the same and that she is still satisfied therewith this 17th day of February A.D. 1860.
