Abraham Cassell to John Albaugh
Land Records, Maryland Exam’d delivered Granted } At the request of John
Albaugh the following deed was This Indenture made this seventh day of
March in the year of our Lord seventeen hundred and ninety one. Between Abraham
Cassell of Frederick County and State of Maryland, Farmer of the one part and
John Albaugh of the same County and State aforesaid Farmer of the other part
Witnesseth that the said Abraham Cassell for and in Consideration of the sum of
thirty pounds current money to him in hand paid by the said John Albaugh the
receipt whereof the said Abraham Cassell doth acknowledge and himself therewith
to be fully satisfied and paid and for and in
consideration of the yearly rent of seven shillings and six pence current money
to be paid to John Young during his natural life and then to be paid to Richard Coale or to his Heirs Executors and Assigns on the twenty second day of June
yearly and every year hereafter forever Hath given granted bargained sold
aliened released and confirmed and by their presents doth give grant bargain
sell alien release and confirm unto him the said John Albaugh his Heirs and
Assigns forever All his the said Abraham Cassell’s right Title Interest and
Property of and in and to all the following Lott of Ground in the Town of
Liberty lying and being in Frederick County aforesaid on a draught of Linganore
called Piney Run being part of a Tract of Land called Dukes Woods it being
numbered Seventy Five of the aforesaid Town Lotts Beginning at a Stone put upon
the North side of the Main Street of said Town and marked JA #75. and
running thence North four degrees West three hundred feet then South eighty six
degrees West fifty feet the South four degrees East three hundred feet then by a
straight line to the Beginning containing and laid out for one of the aforesaid
Town Lotts Together with all and singular the Buildings and all the premises and
appurtenances to the said Lot of Ground belonging or any wise appertaining
thereunto belonging unto him the said John Albaugh his Heirs and Assigns forever
on the Condition above mentioned to the only proper use and Behoof of him the
said John Albaugh his Heirs and Assigns and to no other Intent or Purpose
whatsoever. And the said Abraham Cassell himself and his Heirs Lotts hereby
consonant promise grant and agree to and with the said John Albaugh his Heirs
and Assigns that he the said Abraham Cassell and his Heirs shall from time to
time and at all times forever hereafter warrant and defend the said Lott of
Ground and premises with its appurtenances against – all manner of persons
claiming any right Title Interest or Property unto the said Lott of Ground and
premises with its appurtenances as from by and under him this said Abraham
Cassell and his Heirs. And the said Abraham Cassell doth further consonant
for himself and his Heirs to and with the said John Albaugh his Heirs and
Assigns that to the Abraham Cassell his Heirs shall and will from time to time
and at all times forever hereafter at the proper Cost - and charges of him
the said John Albaugh his Heirs or Assigns do make acknowledge suffer execute
or cause to be made done acknowledged suffered executed all and every such
further and other Act or Acts Thing or Things Assurances or Conveyances in
the Law as by the said John Albaugh his Heirs or Assigns or his or their Council
learned in the Law shall be reasonably devised advised or required for the
further and
better Assurances Surety and Suremaking of all and singular the premises hereby
bargained and sold or intended to be hereby bargained and sold according to the
Intent and Meaning of these presents. In witness whereof the said Abraham
Cassell hath hereunto sd’ his Hand and affixed his Seal the day and Year within

On this 7th day of March 1791 came the within named Abraham Cassell before two of the Justice of the Peace for Frederick County and acknowledged the within Instrument of writing to be his Act and Deed and the Lot and premises therein mentioned to be his Right and Estate of the within named John Albaugh his Heirs and Assigns forever according to Law. At the same time came Catharine Cassell wife of the said Abraham Cassel and being by us privately examined from and out of the hearing of her said Husband and acknowledges her right and dower in the within Lotts of Ground and premises to be the right of the aforesaid John Albaugh senior his Heirs and Assigns forever and that she did the same voluntarily without being induced thereto by Fear or Threats or ill usage from her said husband or for fear of his displeasure.
