20 June 1792, Anthony Bostain to John Albaugh

Exam’d Granted  }        At the request of John Albaugh the following Deed was
24 April 1793      }        recorded 20th June 1792 to wit~~

                This Indenture made this fourth day of June in the year of our Lord one thousand seven hundred and ninety two Between Anthony Bostain of Frederick County and State of Maryland, Farmer of the one part and John Albaugh, Sen’r of the said County and State aforesaid of the other part  Witnesseth that the said Anthony Bostain for and in consideration of the sum of five pounds current money to him in hand paid by the said John Albaugh sen’r the receipts whereof the said Anthony Bostain doth hereby acknowledge and himself thereunto is fully satisfied contented and paid and for and forever   Hath given granted bargained sold aliened released and confirmed and by these presents doth give grants bargain sell alien release unto the said John Albaugh Sen’r his Heirs and Assigns forever All his the said Anthony Bostain Right Title Interest and Property of in and to all the following Tract or Parcel of Land lying and being in the County and State aforesaid and adjoining a Tract of or Parcel of Land formerly called Twikless**  that was granted to Anthony Bostain November the thirteenth seventeen hundred and fifty three and Beginning at the end of five and a quarter perches on the third line of a Tract of Land called Miller Rights design and running with said Land South fifteen degrees West six and three quarters perches to a Stone then South seventy nine degrees West seventy three perches and one quarter of a perch then South seventy degrees East sixty one perches then North thirty degrees East forty five perches then South fifty nine degrees East twenty five perches and one quarter of a perch which is the end of the sixth line of the whole Tract or parcel of Land now called the Standing Stone resurveyed the twentieth day of November seventeen hundred and ninety then with a straight line to the Beginning containing and laid out for eight acres of Land, Together with all and singular the Buildings, Gaits and Fences Water and Water Courses Meadow Orchards and all Improvements thereon with the Premises and Appurtenances To have and to hold the said Tract or Parcel of Land with the Premises and Appurtenances thereunto belonging unto him the said John Albaugh Sen’r his Heirs and Assigns forever on the Condition above mentioned and to no other intent and Behoof of him the said John Albaugh Sen’r his Heirs and Assigns and to no other use Intent or purpose whatsoever.  And the said Anthony Bostain his Heirs and Assigns doth consonant  promise grant and agree that he the said Anthony Bostain his Heirs and Assigns shall and will from time to time and at all times forever here after warrant and defend the said Tract or Parcel of Land and its premises with its Appurtenances against all manner of persons claiming any right Title Interest or Property  unto the aforesaid Tract or Parcel of Land by or under him the said Anthony Bostain his Heirs or Assigns.  And the said Anthony Bostain doth ******** for himself and his Heirs to and with the said John Albaugh his Heirs and Assigns that he  the said Anthony Bostain and his Heirs shall and will from time to time and at all times forever hereafter at the proper cash and charges of him the said John Albaugh en’r his Heirs and Assigns do make acknowledge suffer execute or cause to be made and done acknowledged suffered executed all and every such further and other Act or Acts Thing or Things Assurances or Conveyances in the Law as by the said John Albaugh Sen’r his Heirs and Assigns or his or their Council learned in the Law shall be reasonably devised advised or required for the further and better Assurances Surety and Suremaking of all and singular the premises hereby bargained and sold or hereby intended to be bargained and sold according t the true Intent and Meaning of there presents.  In Witness whereof he the said Anthony Bostain hath hereunto set his Hand and affixed his seal the day and year within written

Which was thus endorsed to wit~~
Received June 4th 1792 of John Albaugh sen’r the sum of five pounds current money the Consideration  expressed in the within deed                      Anthony Bostain

                On the 4th day of June 1792 came the within named Anthony Bostain and acknowledged the within Instrument of Writing  to be his Act and deed and the Land and premises therein mentioned to be the Right and the Estate of John Albaugh sen’r his Heirs and Assigns forever.  At the same time came Catherina Bostain wife of the said Anthony and being by us privately examined from and out of the Hearing of her husband and acknowledged her right of Dower in the within Land and premises to be the right and the Estate of the within John Albaugh sen’r his Heirs and Assigns forever and that she did it freely and voluntarily without being induced thereunto by fear or threats or ill usage from her husband or for fear of his displeasure
