Nicholas Boone to William Albaugh

At the request of William Albough the following Bill of Sale was recorded Sept 9, 1777.

Know all Men by these presents that I Nicholas Boone of Frederick County in the State of Maryland, Farmer for and in Consideration of William Albough being my Security for the Administration of my deceased father’s Howell Boone’s Estate have bargained & sold and by these presents do fully dearly and absolutely bargain and sell unto the said Wiliam Allbough one bay horse the same of Beech branded on the rear thigh with the letters JG  and one grey horse by the name of Grey branded with the letters HA.  To have and to hold the said bay and horse to the said William Albaugh his Executors Administrators and Assigns as his and their our proper Goods and Chattels to his and their own proper use and behoof for ever and I the said Nicholas Boones my Executors and Administrators against all manner of Persons claiming the same shall and will warrant and forever defend by these presents.  Provided always that if I the said Nicholas Boone my Executors and Administrators or any of us, do and shall release, and keep from any Loss and damage Suit or any suits, where by any loss  damage cost or charges may accrue on the said William Albough, on account of the Suretyship aforesaid without fraud or unnecessary delay that then this present Bill of Sale shall be utterly void and of none effect.

The proceeding Bill of Sale was thus endorsed

On the 2nd day of September 1777 Came the within mentioned Nicholas Boone *** and acknowledged the within Bill of Sale to be his Act and deed and the Effects thereby bargained & sold to be the right and Estate of the within named William Albaugh his heirs and Assigns according to the true Intent and meaning thereof.
