Israel Beighler to Zachariah Albaugh

request of Zachariah Albaugh the following Deed was recorded This Indenture made the seventeenth day of
April in the year of our Lord one thousand seven hundred and eighty nine Between
Israel Beighler of Frederick County and State of Maryland of the one part and
Zacharias Albaugh of the same County and State aforesaid of the other part
Witnesseth that the said Israel Beighler for and in consideration of the sum of
twenty five pounds current Gold and Silver money to him in hand paid by the said
Zacharias Albaugh the receipt whereof the said Israel Beighler doth hereby
acknowledge and for and in consideration of the yearly rent of fifteen shillings
current Gold and Silver Money to be paid to John Young or his Heirs Executors
Administrators or Assigns yearly and every year forever which said Annuity to
commence on the 22nd day of June last Hath given granted bargained
sold aliened released and confirmed, and by these presents doth give grant
bargain sell alien release and confirm unto him the said Zacharias Albaugh his
Heirs and Assigns forever all his the said Israel Beighler’s Right Title
Interest and Property of in and to all the following Lotts of Ground in the Town
of Liberty in Frederick County aforesaid on a Draught of Linganore called Piney
Run being part of a Tract of Land called Dukes Woods the said Lotts being Number
195. 196 in the said Town. Beginning at a Stone set up on the North side of
North Street marked IPn195 and running thence North four degrees West
three hundred feet then South eighty six degrees West one hundred feet then
South four degree; East three hundred feet to North Street. Then with said
Street to the Beginning containing two of the Town back Lotts together with all
and singular the Buildings and Improvements and all the premises and
appurtenances to the said back Lotts belonging or in any wise appertaining To
have and to hold the said Lotts of Ground together with the premises and
appurtenances on the Conditions above mentioned unto him the said Zacharias
Albaugh his Heirs and Assigns forever to the only proper use and Behoof of him
the said Zacharias Albaugh his Heirs and Assigns and to no other Intent or
purpose whatsoever. And the said Israel Beighler for himself and his Heirs doth
hereby covenant promise grant and agree to and with the said Zacharias Albaugh
his Heirs and Assigns that he the said Israel Beighler and his Heirs shall and
will from time to time and at all times forever hereafter warrant and defend the
said Lotts of Ground and Premises with its appurtenances against all manner of
persons claiming or to claim Right Interest or Property unto the aforesaid Lotts
of Ground and Premises with its appurtenances from by or under him the said
Israel Beighler and his Heirs. And the said Israel Beighler doth further
covenant for himself and his Heirs to and with the said Zacharias Albaugh his
Heirs and Assigns that he the said Israel Beighler and his Heirs shall and will
from time to time, and at all times forever after at the proper cost and charges
for him the said Zacharias Albaugh his Heirs or Assigns do make acknowledged
suffer execute or cause to made done acknowledged suffered and executed all
every such further and other Act of Acts Thing or Things or Conveyances in the
Law as by the said Zacharias Albaugh his Heirs and Assigns or his or their
Council learned in the Law shall be reasonably devised advised or required for
the premises hereby bargained and sold or intended to be bargained and sold
according to the true intent and meaning of these presents. In witness whereof
the said Israel Beighler hath hereunto set his hand and Seal the day and year
above written. On the back whereof were thus endorsed to wit ~~ Received this seventeenth day of April 1789,
of Zacharias Albaugh the sum of twenty five pounds current Gold and Silver Money
the Consideration expressed in the within Deed except the yearly rent of fifteen
shillings current Gold and Silver Money as mentioned in the within
Deed.
Israel Bigler
On the 17th day of April 1789.
came the within named Israel Bigler before two of the worshipful Justices of the
Peace for Frederick County and acknowledged the within Instrument of Writing to
be his Act and deed, and the Lotts of Ground and premises therein mentioned to
be the Right and Estate of the within named Zacharias Albaugh his Heirs and
Assigns forever. At the same time came Catharine Bigler wife of the said Israel
Bigler and being by us privately examined apart from and out of the hearing of
her said husband declared that she acknowledged her Right of the Lotts within
mentioned and that she did the same freely and voluntarily without being induced
thereto by fear or threats of ill usage from her said husband or for fear of his
displeasure.
