George Bartow to William Albaugh

 

This Indenture made this twenty ninth day of September in the year of our Lord one thousand eight hundred and forty nine by and between George Bartow and Matilda his wife of the County of Harrison in the State of Ohio of the one part and William Albaugh of the County of Carroll and State aforesaid of the other part.  Witnesseth that the said George Bartow and Matilda his wife for and in consideration the just sum of twenty five hundred dollars of lawful money of the United States of America to them in hand paid the receipt whereof they do hereby acknowledge have granted, bargained , sold, released and conveyed and do by these presents grant bargain sell release convey and confirm unto the said William Albaugh and his heirs and assigns forever all that tract or parcel of land situate and lying in the County of Harrison in the State of Ohio and beginning at the South east corner of Section No. two in Township No. thirteen of Range No. six of the Lands directed to be sold at Steubenville Ohio beginning at the South east corner thence North to a hickory on the North bank of the crick standing as a line tree between John McDonough and said George Bartow then westwardly to line with the Connotten Crick until it comes to George Skipper and to have and to be the crick within said bounds until it comes to said Skippers land and thence South with the line between Bartow and Skipper until it comes to a certain post between said Bartow and Skipper standing as a corner post thence east along the line between John Minard land and said Bartow to the place of beginning and to contain one hundred and three acres less or more and to contain all the land said Bartow now owns in the said tract of land and also the east half of the North west quarter of Section No. one of Township thirteen of Range six in the District of land subject to sale at Steubenville Ohio except forty acres of the South end deeded to John McDonnough.  To have and to hold the premises aforesaid with all the privileges and appurtenances therein to belonging or in anywise appertaining unto him the said William Albaugh and unto his heirs or assigns and the said George Bartow and Matilda his wife for themselves and for their heirs, executors and administrators covenant and promise to and with the said William Albaugh his heirs and assigns that the said George Bartow and Matilda his wife will well and truly warrant and forever defend the premises herein and hereby granted unto the said William Albaugh and to his heirs and assigns against the lawful claims of all and every person whomsoever.  In Testimony whereof the said George Bartow and Matilda his wife parties of the first part have hereunto set their hands and seals the day and year above written.

On the 29th day of September A.D. 1829 I, one of the subscribers, a Justice of the Peace within and for said county Personally appeared the said George Bartow and Matilda Bartow wife of said George Bartow who signed and sealed the foregoing deed and acknowledged the signing and sealing thereof to be there act and deed and the said Matilda Bartow wife of said George Bartow being by me examined separate and apart from his said husband and the contents of said deed being fully made known to her by me examined separate and apart from her said husband and the contents of said deed being fully made known to her by me reading the same she did declare upon such separate examination that she did voluntarily sign seal and acknowledge the same and that she is still satisfied therewith and from my own personal knowledge I am satisfied they are the parties they represent themselves to be.  Given under my hand and seal the day and year above written.
