Basil Allbaugh to Wm H. Stephenson

 

Know all men by these presents, that we Basil Albaugh & Nancy Albaugh wife of the said Basil Albaugh and Robert P. Albaugh of the County of Harrison and State of Ohio in consideration of the sum of Twenty nine hundred and sixty Dollars to us in hand paid by Wm * H. Stephenson of the County of Harrison, State of Ohio do hereby grant, bargain, sell and convey to the said W. * H. Stephenson his heirs and assigns forever the following premises situate in the County of Harrison and State of Ohio in the District of Lands directed to be sold at Steubenville Ohio and bounded and described as follows, being a part of the southwest corner of said section (31) of Township 12, in Range 5 beginning for the same at the south west corner of said section and running thence South 88.20 east 147.56 perches thence North 8º West 118.24 perches North 89º west 68.4 perches south 40 west 111.24 perches North 78 ¾ west 50 perches South 10 west 14 rods to the place of beginning, containing 68 acres 2 rods 22 perches more or less and all the estate title and interest of the said Basil Albaugh, Nancy Albaugh and Robert P. Albaugh either in law  or in equity of in and to the said premises together with privileges and appurtenances thereto belonging.

                To have and to hold to the said Wm * H. Stephenson his heirs and assigns forever and the said Basil Albaugh, Nancy Albaugh & Robert P. Albaugh for themselves and for their heirs, executors & administrators do hereby covenant with the said Wm * H. Stephenson his heirs and assigns that “he’s” the true and lawful owner of the said premises and has full power to convey the same and that the title so conveyed is clear, free and unencumbered and further that they will warrant and defend the same against all claims or claims of all persons whomsoever.

                In witness whereof the said Basil Albaugh, Nancy Albaugh wife of Basil Albaugh and Robert P. Albaugh have hereunto set their hands and seals this 5th day of March A.D. 1867.

The State of Ohio County of Harrison SS.
                Before me Robert Anderson a Justice of the Peace in and for said County personally came the above named Basil Albaugh, Nancy Albaugh & Robert P. Albaugh and acknowledged the signing and sealing “theirof”  to be their voluntary act and deed.  And the said Nancy Albaugh wife of said Basil Albaugh being examined by me separate and apart from her said husband and the contents of said Deed being by me made known and explained to her as the statue directs declares that she did voluntarily sign seal and acknowledge the same and that she is still satisfied therewith as her act and deed for use and purposes therein mentioned.
                In Testimony whereof I have hereunto subscribed my name and affixed my seal on the day and year aforesaid this 5th day of March A.D. 1867.             Robert Anderson  (Seal)

I hereby certify that the Deed of which the foregoing is a copy had adhesive stamps attached to the value of Three Dollars which were duly cancelled according to law.  I further certify that said Deed was entered for Record August 20th 1869.        Recorded September 24the 1869.
