Basil Allbaugh to RJ Stephenson

DEED      Basil Allbaugh & wife to R.J. Stephenson

Know all men by these presents:  That We Basil Allbaugh and Nancy Allbaugh wife of the said Basil Allbaugh of the County of Harrison and State of Ohio in consideration of the sum of Seventeen Hundred Dollars to us paid by R.J. Stephenson of the County of Harrison and State of Ohio, the receipt whereof is hereby acknowledged do hereby Grant, Bargain, Sell and Convey to the said R.J. Stephenson and his heirs and Assigns forever the following Real Estate situated in the County of Harrison in the State of Ohio and in the Steubenville Land District and bounded and described as follows:  to wit, The same being a part of Section No. 32 of Township (12) of Range (5) beginning for the same at the South East corner of the Lot now owned by Thomas Somerville, thence North 29˝° East 29 88/100 perches to the North East corner of said Somerville’s lot.  Thence South 49˝° East 11 58/100 perches to a stone at the North west corner of Thomas Heidy’s lot.  Thence South 34˝° west 29 46/100 perches to a stone at the south west corner of said Heidy’s lot.  Thence North 49˝° West 8 74/100 perches to the place of beginning and containing One Acre Three Roods and Fourteen perches.
                To have and to hold said premises with all the privileges and appurtenances thereunto belonging to the said R.J. Stephenson his heirs and assigns forever.  And the said Basil Allbaugh and Nancy Allbaugh his wife for themselves and their heirs, do hereby covenant with the said R.J. Stephenson his heirs and assigns that they are lawfully seized of the premises aforesaid; that the said premises are Free and Clear from all incumbrances whatsoever; and that they will forever Warrant and Defend the same with the appurtenances unto the said R.J. Stephenson his heirs and assigns against the lawful claims of all persons whomsoever.
                In witness whereof, the said Basil Allbaugh and Nancy Allbaugh his wife who hereby releases all right of dower in the premises have hereunto set their hands and seals this 15th day of September in the year of our Lord one thousand eight hundred and seventy three.

State of Ohio, Harrison County S.S.
Be it remembered that on this 15th day of September A.D. 1873 before me the subscriber, a Justice of the Peace in and for said County, personally came the above named Basil Allbaugh and Nancy Allbaugh his wife the Grantors in the foregoing Deed and acknowledged the signing and sealing of the same to be their voluntary act and deed for the uses and purposes therein mentioned.  And the said Nancy Allbaugh wife of the said Basil Allbaugh being at the same time examined by me, separate and apart from her said husband and the contents of said Instrument being by me made known and explained to her she then declared that she did voluntarily sign seal and acknowledge the same and that she is still satisfied therewith as her voluntary act and deed for the uses and purposes therein mentioned.  In Testimony whereof I have hereunto subscribed my name on the day and year last aforesaid.
