Valentine Baist to Zachariah Albaugh

Granted At the request of Zachariah Albaugh the
following deed was recorded This Indenture made this seventh day of
February in the year of seventeen hundred and ninety nine, Between Valentine
Baist of Frederick County in the State of Maryland of the one part and Zachariah
Albaugh of the county and state aforesaid of the other part. Witnesseth that
the said Valentine Baist for and in consideration of the sum of thirty pounds
current money to the said Valentine Baist in hand paid by the said Zachariah
Albaugh at and before the sealing and delivery of these presents. (The receipt
whereof the said Valentine Baist doth hereby confess and acknowledge and thereof
and there from entirely acquit, release and discharge the said Zachariah Albaugh
his heirs, executors, administrators and assigns) and the said Valentine Baist
being therewith contented and satisfied hath granted bargained & sold, and by
these presents doth fully, clearly and absolutely grant, bargain, sell,
transfer, convey, enfeoff and confirm unto the said Zachariah Albaugh his heirs
and assigns forever, all that tract or parcel of land lying and being in
Frederick County aforesaid, being part of a Tract called Errors Corrected.
Beginning at a stone erected at the end of sixty perches on the tenth line of a
tract of land called Red Sand as surveyed with two degrees allowance for
variation being the end of the thirty eighth course of the whole tract called
Errors Corrected and running with the thirty ninth line of said land reversing
the aforesaid tenth line of Red Sand North thirty six degrees East sixteen
perches to a stone then leaving said lands and running South sixty eight and one
half degrees East fifty two perches to a stone erected at the end of fifty four
and one half perches on the seventh line of Jacob Burgoons land conveyed to him
by the aforesaid Valentine Baist being also the end of fifty four and one half
perches on the twentieth line of the aforesaid tract called Errors Corrected
then with eight degrees West thirty nine and one half perches to a stone South
thirty six degrees West one hundred and nineteen perches to a stone then north
twenty degrees West nine perches and five links to a stone erected at the end of
the thirty third line of the aforesaid whole tract called Errors Corrected then
with said land South sixty two degrees East two and one half perches North
thirty six degrees East eighty nine and one half perches to the thirty sixth
line of a tract of land called The Resurvey of Friendship resurveyed for said
Valentine Baist the seventeenth day of May seventeen hundred ninety four as run
with two degrees allowance for variation then with said line North thirty three
degrees West twelve perches and one quarter of a perch to the fifth line of a
tract of land called Good Will as surveyed with two degrees allowance for
variation then with said line to the end thereof North thirty six degrees East
eighteen and one quarter perches then with the given line of said Good Will
North twenty nine and three quarters degrees West twenty eight perches to the
Beginning Stone containing thirteen acres and three quarters of an acre together
will all buildings fences, improvements, members, profits, issues, commodities
and advantages whatever unto the same belonging or in any wise appertaining and
also all the estate, right, title, interest, claim, and demand both in Law and
Equity of the said Valentine Baist of in and to the aforesaid bargained land and
premises and every part and parcel thereof with all and every of the
appurtenances. To have and to hold all and singular the land and premises
hereby granted and conveyed or mentioned, meant and intended so to be unto the
said Zachariah Albaugh his heirs and assigns to the only proper use, benefit and
behoof of the said Zachariah Albaugh his heirs and assigns forever, and to and
for no other use, intent or purpose whatever. And the said Valentine Baist for
himself and his heirs doth covenant, promises and grant to and with the said
Zachariah Albaugh his heirs and assigns that the said Valentine Baist and his
heirs the aforesaid bargained land and premises and every part and parcel
thereof with the appurtenances unto the said Zachariah Albaugh his heirs and
assigns against the said Valentine Baist and his heirs and all manner of person
or persons whatsoever claiming by from or under him them or any of them shall
and will warrant and forever defend by these presents. In Testimony whereof the
said Valentine Baist hath hereunto set his hand and affixed his seal the day and
year first before written. On the seventh day of February seventeen
hundred ninety nine came personally before us the subscribers two Justices for
Frederick County Valentine Baist party to the foregoing Instrument of Writing
and acknowledged the same to be his act and deed and the land and premises
therein mentioned to be the right and estate of the therein named Zachariah
Albaugh his heirs and assigns forever. |
