Albaugh Family to Richard Coale

                  At the request of Richard Coale the following Deed is recorded 13th August 181, to wit~

This indenture made this 25th day of April in the year of our Lord one thousand eight hundred and twelve between Conrad Stuck and Barbara Stuck his wife, Philip Albaugh, Isaac Cobate and Mary Cobate his wife, John Albaugh and Peter Albaugh all of Bedford County in the state of Pennsylvania of the one part and Richard Coale of Frederick County in the State of Maryland of the other part, Whereas Philip Albaugh late of Frederick County in the State of Maryland deceased died  seized in fee and possessed of a certain tract or parcel of Land lying and being in Frederick County and State of Maryland aforesaid called “The Crooked Slipe” and by his last Will and Testament dated the twenty third day of July seventeen hundred and ninety five and Recorded in the Register of Wills office for Frederick County aforesaid directed the same should be sold by his Executrise Barbara Albaugh and the proceeds of such sale distributed equally among his children, namely, Barbara, Philip, Mary, John and Peter as they become of age.  And whereas his said Executrise did not sell the said Land, and is now also deceased; and the aforesaid Barbara who intermarried with Conrad Stuck, Philip Albaugh, Mary who intermarried with Isaac Cobate, John Albaugh and Peter Albaugh being all of lawful age and entitled to equal shares in the said land, have agrees for and sold the same to the said Richard Coale.  Now this Indenture witnesseth that the said Conrad Stuck and Barbara his wife, Philip Albaugh, Isaac Cobate and Mary his wife, John Albaugh and Peter Albaugh for and in consideration of the sum of five hundred and fifty eight dollars current money to them in hand paid by the said Richard Coale before the ensealing and delivery of these presents the receipt whereof is hereby acknowledged.  Have and by these presents do grant bargain and sell, alien, release, enfeoff and confirm unto the said Richard Coale his heirs and assigns forever all their and each of their estate, right, title, and interest of in and to all that Tract or parcel of Land, which the said Philip Albaugh died seized and possessed of, situate, lying and being in Frederick County and State of Maryland aforesaid on the waters of Israels Creek called “The Crooked Slipe”  Beginning for the same at a stone now planted at the end of the first line of a tract of land called The Resurvey on Albaugh’s Choice originally on the twenty ninth day of January seventeen hundred and fifty four granted William Albaugh for five hundred and thirty acres and running thence with the said Resurvey South seventy four degrees East forty perches to a stone South fifty nine degrees East sixty perches to a stone South seventy six degrees East twenty perches to a stone North eighty degrees East forty perches to a stone South twenty degrees West twenty and an half perches to a stone at the end of the thirty third line of a tract called The Resurvey on Spring Garden and with said land North eighty one degrees East forty eight and three quarters perches to a stone at the end of the twelfth line of a tract of Land called Warfields Good Luck and with said land reversed  North one hundred nine and an half perches to a stone North forty five degrees West seven and a half perches to a stone at the end of eighteen and three quarters perches on the sixteenth line of a Tract of Land called Chestnut Level and with said land South eighty one and a quarter perches to a stone South seventy nine and a half degrees West fifty four perches to a stone at the end of the sixth line of a tract  of Land called Albaugh’s Choice granted Zachariah Albaugh August the eleventh 1753 for one hundred and twenty five acres and with it reversed North sixty seven degrees West ninety six perches to a stone South seventy degrees West thirty four perches to a stone then by a straight line to the first beginning containing thirty one acres as surveyed December 16th 1788.  Together with all and singular the premises and appurtenances thereunto belonging or in anywise appertaining.  To have and to hold the land and premises hereby intended to be conveyed to the said Richard Coale his heirs and assigns forever to the only proper use and behoof of him the said Richard Coale his heirs and assigns forever and to and for no other use intent or purpose whatever.  And the said Conrad Stuck and Barbara his wife, Philip Albaugh, Isaac Cobate and Mary his wife, John Albaugh and Peter Albaugh for themselves their heirs Executors and administrators, do covenant and agree to and with the said Richard Coale, his heirs and assigns that they the said Conrad Stuck and Barbara his wife, Philip Albaugh, Isaac Cobate and Mary his wife, John Albaugh and Peter Albaugh and their heirs shall and will warrant and defend the Land and premises hereby intended to be conveyed to the said Richard Coale his heirs and assigns from and against them the said Conrad Stuck and Barbara his wife, Philip Albaugh, Isaac Cobate and Mary his wife and John Albaugh and Philip Albaugh (S.B. Peter)  and from and against all persons claiming or to claim by from or under them or any or either of them.  And further that they the said Conrad Stuck and Barbara his wife, Philip Albaugh, Isaac Cobate and Mary his wife, John Albaugh and Peter Albaugh and their heirs shall and will at any time hereafter at the request and costs of the said Richard Coale his heirs or assigns make do, execute and acknowledge any other deed or Instrument of Writing that may be necessary more effectively to convey the land and premises hereby intended to be conveyed to the said Richard Coale his heirs and assigns forever, the said deed containing no other or greater warranty than is herein.  In witness whereof the said Conrad Stuck and Barbara his wife, Philip Albaugh, Isaac  Cobate and Mary his wife, John Albaugh and Peter Albaugh have hereto subscribed their names and affixed their seals the day and year first herein before written ~~

To which deed were annexed the following; Commission & acknowledgements, to wit;
Maryland, Frederick County,  The State of Maryland
{    Seal    }    To Mesrs John Hershberger, Samuel Lowry and John Hindman of Bedford County in the State of Pennsylvania, gentlemen  Greeting:

You are hereby commissioned and full forever and authority are given unto you or any two of you, to take the acknowledgements of Conrad Stuck and Barbara Stuck his wife, Philip Albaugh, Isaac Cobate and Mary Cobate his wife, John Albaugh and Peter Albaugh of a certain deed or conveyance already executed or to be executed by the said Conrad Stuck and Barbara his wife Philip Albaugh, Isaac Cobate and Mary his wife, John Albaugh and Peter Albaugh , to Richard Coale of Frederick County in the State of Maryland Thereby conveying and transferring, or intending to do, unto the said Richard Coale his heirs and assigns, the fee simple, or other estate, of in and to a certain tract or parcel of Land situate, lying and being in Frederick County and State of Maryland aforesaid called “The Crooked Slipe” containing thirty one acres with the appurtenances and that you or any two of you examine the said Conrad Stuck and Barbara his wife, Philip Albaugh, Isaac Cobate and Mary his wife, John Albaugh and Peter Albaugh and Barbara Stuck the wife of the said Conrad Stuck, Elizabeth Albaugh the wife of the said Philip Albaugh and Mary Cobate wife of the said Isaac Cobate out of the hearing and presence of their said husbands “Whether they do make their acknowledgement thereto voluntarily”  and when you or any two of you have taken the acknowledgements of the said Conrad Stuck and Barbara  Stuck his wife, Philip Albaugh, Isaac Cobate and Mary his wife, John Albaugh and Peter Albaugh and privately examined the said Barbara Stuck Elizabeth Albaugh and Mary Cobate aforesaid that you or any two of you, certify the said acknowledgements and private examinations as aforesaid under your, or any two of your hands and seals, and return the same to the County Court of Frederick County, with the said deed or conveyance, and this commission, to be recorded amongst the Records of said County Witness the Honourable John Buchanan Esquire, Chief Judge of the fifth Judicial District of the State  of Maryland the third day of February in the year of our Lord eighteen hundred and twelve.

State of Pennsylvania, Bedford County, to wit ~~

In obedience to the within Commission to us directed we the subscribers Commissioners therein named hereby certify to the County Court of Frederick County within the State of Maryland that on this 25th day of April in the year of our Lord one thousand eight hundred and twelve personally appear Conrad Stuck and Barbara Stuck his wife, Philip Albaugh, Isaac Cobate and Mary his wife, John Albaugh and Peter Albaugh the party Grantors named in the deed or Instrument of Writing hereunto announced and acknowledge the said Deed or Instrument of Writing to be their respective act and Deed.  We also certify that the said Barbara Stuck the wife of the said Conrad Stuck, Elizabeth Albaugh the wife of Philip Albaugh and Mary Cobate the wife of the said Isaac Cobate, being by us privately examined, apart and out of the hearing and presence of their respective husbands “Whether they do make their acknowledgements, voluntarily” declare and each of them declares and acknowledges that she doth make such acknowledgment voluntarily.  Given under our hands and seals, the day and year above written ~~                                                                                        John Harshberger  (seal)
