Abraham Albaugh to Richard Potts

Ex’d Del’d Granted  }                           At the request of Richard Potts the following deed was recorded
14 April 1803           }                          August 20th 1798, to wit ~~

This Indenture made this twentieth day of August in the year of our Lord one thousand seven hundred and ninety eight, Between Abraham Albaugh and Margaret his wife the daughter of Valentine Adams late of Frederick County deceased of the one part and Richard Potts of Frederick County of the other part.  Whereas Valentine Adams in his lifetime was seized of an Estate in Fee Simple of a Lott of Land lying in Frederick County called Number Seven containing five acres being part of a Tract of Land called Pepe Meadow which part containing five acres was conveyed to him, by a certain George Sticker by deed dated the thirty first day of May seventeen hundred and seventy one as by the same deed recorded among the Land records of Frederick County in Liber O folio’s 406 & 407 will appear and being so seized died intestate leaving the said Margaret with other children to whom his lands decended equally.  Now this Indenture Witnesseth that the said Abraham Albaugh and Margaret Albaugh for and in consideration of the sum of Twenty one dollars to them in hand paid by the said Richard Potts before the sealing and delivery of these presents the receipt whereof is hereby acknowledged have given granted bargained sold aliened released enfeoffed and confirmed and by these presents do give grant bargain sell alien release enfeoff and confirm unto the said Richard Potts and his heirs   All her, the said Margaret Albaugh’s undivided part of the said Lott of Land containing five acres as herein before described.  And all their Estate, Right, Title, Interest, property claim and demand of in and to the same  To Have and to hold her the said Margaret Allbaughs undivided part of the said five acres of land and all the estate right title interest property claim and demand of them and each of them of in and to the same to the said Richard Potts, his heirs and assigns forever, to the only proper use and behoof of the said Richard Potts his heirs and assigns and to or for no other use intent or purpose whatsoever.  And the said Abraham and Margaret Allbaugh do hereby for themselves their heirs Executors and Administrators Covenant and agree to and with the said Richard Potts his heirs and assigns to warrant and defend to him and them the said five acres of Land against them the said Abraham and Margaret Allbaugh, each of them and from and against all person claiming or to claim under them or either of them, their or either of their, or heirs or assigns and further that they and their heirs shall and will at any time hereafter at the request of the said Richard Potts his heirs or assigns execute any other deed which may be necessary more effectively to convey to him or them all the claim right and title of the said Margaret to the said five acres of Land aforesaid.  In Witness whereof the said Abraham and Margaret Allbaugh have hereunto subscribed their names and affixed their seals the day and year first herein before written ~~

Frederick County, to wit ~  Be it remembered that on the twentieth day of August 1798.  Abraham Albaugh appeared before us the subscribers two Justices of the Peace for the county aforesaid and acknowledged the within Instrument of Writing to be his act and deed according to the Act of Assembly in such cases made and provided.  On the same day and year Mrs. Margaret Allbaugh wife of the within named Abraham Allbaugh appeared before us and acknowledged the within Instrument of Writing as her act and deed and being by us privately examined apart from and out the presence and hearing of her said husband declared the she doth make her acknowledgement of the same willingly and freely and without being induced thereto by fear or threats of or ill usage by her husband or fear of his displeasure.
