Abraham Albaugh to Joseph Etzler

At the request of Joseph Etzler the following
Mortgage is
31 Dec’r 1813 } recorded, 18th
October 1811, to wit ~
This Indenture made this seventeenth day of October Eighteen hundred and Eleven
between Abraham Albaugh of Frederick County and State of Maryland of the one
part and Joseph Etzler of the same County and State of the other part.
Witnesseth that the said Abraham Albaugh for and in consideration of the sum of
two hundred and sixty dollars to him in hand paid by the said Joseph Etzler the
receipt whereof the said Albaugh doth hereby acknowledge and himself therewith
to be fully satisfied & paid hath given granted bargained & sold aliened
enfeoffed and confirmed and by these presents doth give grant bargain sell alien
enfeoff and confirm unto the said Joseph Etzler his heirs and assigns forever
the Land and plantation whereon the said Abraham Albaugh now lives it being, the
same devised to the said Abraham Albaugh by his father, William Albaugh and
lying and being in Frederick County aforesaid containing about two hundred and
one acres of Land called the Resurvey on Albaughs Choice. To have and to hold
the said bargained Lands & premises with the appurtenances thereunto belonging
unto the said Joseph Etzler his heirs and assigns forever to the only proper use
and behoof of the said Joseph Etzler his heirs and assigns & to or for no other
use Intent or purpose whatsoever provided never the less and it is the true
intent & meaning of these presents that if the said Abraham Albaugh his heirs
executors administrators or assigns do and shall well and truly pay or cause to
be paid unto the said Joseph Etzler his heirs Executors administrators or
assigns the aforesaid sum of two hundred and sixty dollars with legal interest
thereon from the date of this Instrument of writing in six months from the date
hereof then this Instrument of writing and every cause & matter & thing therein
contained to be void and no effect otherwise to be and remain in full force and
virtue in Law. In witness whereof the said Abraham Albaugh hath hereunto set
his hand and affixed his seal the day and year first above written ~~

Which is thus endorsed, to wit ~
On the 17 day of October 1811 the within
named Abraham Albaugh came before us two Justices of the Peace in & for
Frederick County in the state of Maryland and acknowledged the afore going
Instrument of Writing to be his act and deed and the Lands and premises therein
mentioned to be the right title and Estate of the within named Joseph Etzler his
heirs and assigns forever according to the true intent and meaning
thereof.
