DEED
James F. Kerby & Lydia Jane Kerby to Morris
Albaugh
Know all men by these
presents: That we James F. Kerby and Lydia Jane Kerby wife of said James F.
Kerby of the County of Harrison and State of Ohio, in consideration of the sum
of Three hundred $300.00 Dollars to us paid by Morris Albaugh, the receipt
whereof is hereby acknowledged, do hereby Grant, Bargain, Sell and Convey to the
said Morris Albaugh his heirs and assigns forever, the following Real Estate
situated in the County of Harrison in the State of Ohio and in the Town of
Franklin and bounded and described as follows: Being Lot number twenty (20) in
said Town of Franklin Harrison County Ohio, as it stands on the record in the
proper office of said county. To have and to hold said premises with all the
privileges and appurtenances thereunto belonging to the said Morris Albaugh his
heirs and assigns forever.
And the said James F. Kerby and Lydia Jane Kerby his wife for
themselves and their heirs do hereby covenant with the said Morris Albaugh and
his heirs and assigns that we are lawfully seized of the premises aforesaid:
that the said premises are Free and Clear from all Incumbrances whatsoever: and
that we will forever Warrant and Defend the same, with the appurtenances unto
the said Morris Albaugh his heirs and assigns against the lawful claims of all
persons whomsoever.
In witness whereof, the said James F. Kerby and Lydia Jane Kerby
wife of said James F. Kerby who hereby releases her right of dower in the
premises do herewith set their hands and seals this first day of March in the
year of our Lord one thousand eight hundred and seventy seven.

Be it remembered That on the first day of March A.D. 1877 before me the
subscriber, a Justice of the Peace in and for said County, personally came the
above named James F. Kerby and Lydia Jane Kerby his wife the Grantors in the
foregoing Deed and acknowledged the signing and sealing of the same to be their
voluntary act and deed for the uses and purposes therein mentioned. And the
said Lydia Jane wife of the said James F. Kerby, being at the same time examined
by me separate and apart form her said husband and the contents of said
Instrument being by me made known and explained to her she then declared that
she did voluntarily sign seal and acknowledge the same and the she is still
satisfied therewith as her voluntary act and deed for the uses and purposes
therein mentioned.
In Testimony whereof, I have hereunto subscribed my name on the
day and year last aforesaid.
